Exhibitor at Estate Planning Conference Weighs in on DAPTs versus FAPTs
The 48th Annual Heckerling Institute on Estate Planning, the largest estate planning conference, was held on January 13 – 17, in Orlando, Florida. A focus of the conference this year was domestic asset protection trusts (DAPTs) and foreign asset protection trusts (FAPTs). One panelist shared his belief that DAPTS have failed. A long time exhibitor at the conference, Donlevy-Rosen & Rosen, P.A., recently published an article on the issue.
Donlevy-Rosen & Rosen’s article addresses the tension between proponents of DAPTs and proponents of FAPTs. The article answers many misconceptions in the debate of DAPTs versus FAPTs, including the likelihood of failure, reliability, cost, and legal issues related to each of the two trusts.
