The election of Donald Trump in 2024 ushered in a new wave of fears for non-citizens and their families residing in the United States. Fears of death, loss of property, and loss of parents for minor children brought on by deportation efforts are issues that are finding their way into the estate planner’s office. This Article considers the practical, ethical, and legal issues that estate planners may encounter as deportation efforts continue. Part II describes the different types of aliens and their legal classification. Part III offers techniques and guidelines for planning for minor children, particularly those who are U.S. citizens and may remain in the United States after the deportation of a parent. Part IV offers techniques and
guidelines for planning the management of the property of a deported person. Part V considers the applicability of some of the immigration-related crimes to the estate planning attorney as well as related ethical concerns. Part VI concludes.
