Update on Texas Judicial Developments

With advance apologies for self-promotion, my article, Wills and Trusts, 58 SMU L. Rev. 1205 (2005), has just been published as part of SMU’s Annual Survey of Texas Law.

This article discusses judicial developments relating to the Texas law of intestacy, wills, estate administration, trusts, and other estate planning matters during the survey period of November 2, 2003 through November 1, 2004.  * * * The discussion of most cases includes a moral, that is, the important lesson to be learned from the case.  By recognizing situations which have lead to time consuming and costly litigation in the past, a practitioner may be able to reduce the likelihood of the same situations arising with his or her clients.

I have reprints available of this article.  I you would like one, let me know and I’ll send it to you.

Note that updates of cases decided since November 1, 2004 are available on my website.
