Revocable trust subject to elective share rights
The Iowa legislature amended its forced share statute in 2005 to included revocable trusts created by a deceased spouse in the property from which a surviving spouse may seek a share.
In Sieh v. Sieh, 713 N.W.2d 194 (Iowa 2006), the court held that revocable trusts were also included under prior law, citing and relying on Restatement (Third) Property (Wills and Donative Transfers) § 9.1(c) and Restatement (Third) Trusts § 25.
