James Brown — The Story Continues

Brown2 According to AP, Brown’s will drawn up before marriage, son, Jan. 16, 2006,

James Brown’s will, which was read last week and excludes his partner, Tomi Rae Hynie, and their 5-year-old son, was drawn up 10 months before the child’s birth and more than a year before their marriage. * * * The will was signed August 1, 2000 [and was prepared by] Strom Thurmond Jr., Brown’s probate attorney in Aiken, South Carolina * * *

As previously discussed on this blog, there is debate whether Tomi Rae was legally married to James Brown.  If the marriage was legal, she may be entitled to a share as an omitted spouse or have a right to a forced share.  In addition, the child may be entitled to a pretermitted child’s share.

Special thanks to Prof. Adam Hirsch for alerting me to this new development.
