Langbein and Waggoner’s Uniform Trust and Estate Statutes, 2009-2010 ed.

Langbein and Waggoner’s Uniform Trust and Estate Statutes, 2009-2010 Edition is publishing in early December and will be available for winter/spring 2009 courses. The 2009-2010 edition contains full text and official comments of the Uniform Probate Code, incorporating the 2008 amendments recently promulgated by the Uniform Law Commission. Among the most important revisions to the Code:

  • Intestacy and class gifts: New or substantially revised sections dealing with nonmarital children, adopted children, and children of assisted reproduction
  • Execution of Wills. Notarized wills are now authorized as an alternative to wills that are attested by two witnesses
  • Reformation and Modification. New §§ 2-805 and 2-806 bring the reformation and modification sections now contained in the Uniform Trust Code into the Uniform Probate Code
  • In addition, technical amendments revise the elective share (§§ 2-201 through 2-214) and antilapse provisions (§§ 2-603, 2-706, and 2-707)
