The Uniform Trust Code has now been enacted in twenty-one jurisdictions. This article discusses how the UTC treats the claims of beneficiaries’ creditors and how those provisions of the UTC have been modified in the enacting jurisdictions. The article also addresses criticisms of the UTC provisions on the rights of trust beneficiaries’ creditors.
