How to handle complaining beneficiaries
Robert Whitman, (Professor of Law, University of Connecticut School of Law) has recently published his article entitled Dealing Fairly with Estate and Trust Beneficiary Complaints, 22 Quinnipiac Prob. L.J. 46 (2008).
Prof. Whitman explains that
The premise set forth in this article is that it is in the interests of all parties to an estate or trust administration that complaints by members of the beneficiary group have a fair hearing. While formal in-court litigation permits a fair hearing where there are large sums and/or wealthy complainants involved, it is not an effective mechanism for “powerless beneficiaries.” Various alternative dispute mechanisms, when appropriately employed, can provide a fair hearing; and it is in the best interests of all of the parties that they be used.
