Dying is insufficient “notice to vacate”

LeaseDeath may not end one’s legal responsibilities.

The following situation is described in Frank C. Giradot, Rent demanded from family of Covina massacre victims, DailyBulletin.com, Feb. 4, 2009:

  • Alice Ortiz was murdered on December 24, 2008.
  • Alice was renting an apartment from Broadstone Foothill Apartment Homes.
  • The landlord submitted a bill on January 29, 2009 claiming Alice owes $1,655 for leaving the apartment without giving the mandated notice to vacate.
  • The landlord is also charging rent and fees for a portion of the period after she died until presumably her apartment was emptied of her belongings and again available for rent.
