Link to Iowa case holding same-sex marriage ban unconstitutional now available
Earlier today, I reported that the Iowa Supreme Court held that the Iowa statute banning same-sex marriage is unconstitutional as a violation of equal protection. Here is some additional information:
The style of the case is Varnum v. Brien (No. 07-1499) and the link to the opinion is now active although you may need to wait as the court’s website is extremely busy.
Same-sex couples may not yet take advantage of this opinion. The opinion is effective in 21 days unless a petition for rehearing is filed. Thus, at a minimum, same-sex couples need to wait 21 days to marry and perhaps much longer if a petition for rehearing is filed.
