St. Olaf Appeal Filed

St_olaf On April 23, 2009, attorneys for SaveWCAL filed an appellate brief with the Minnesota Court of Appeals, appealing the order of the district court discussed here.  The brief contends that St. Olaf, acting as trustee of the WCAL charitable trust, improperly sold assets held by the trust.  The brief concludes as follows:

The protection of the public interest is the paramount goal of the law of charitable trusts.  The public policy to protect the beneficiaries of a charitable trust must be enforced in the appropriate case.  This is that case.  Save WCAL requests this Court to reverse the judgment of the district court and to remand the case with instructions to enter judgment in favor of SaveWCAL for the relief requested in its Petition: to declare the transaction void and to remove St. Olaf College as trustee.
