Changes to States’ Joint Tenancy Laws Threaten Joint Tenancies
John V. Orth (professor of law, University of North Carolina) recently published his article entitled The Perils of Joint Tenancies, 44 Real Prop. Trust & Estate L.J. 427 (2009).
The editor’s synopsis of the article is below:
In this Article, the Author provides a general overview of the historical development of the joint tenancy and how the changes that many states have made to joint tenancy laws affect the estate. The Author expresses concern that these recent changes threaten both the stability of current joint tenancy estates and the viability of the ancient form of estate itself.
