Kentucky Repeals Rule Against Perpetuities

KentuckyThe state of Kentucky has repealed its rule against perpetuities. 

H.B. 188, signed into law by the governor of Kentucky on March 18, 2010, contained a number of changes for trusts and estates, including this new section of KRS Chapter 381:

An interest created in real or personal property shall not be void by reason of any rule against perpetuities, whether the common law rule or otherwise. The common law rule against perpetuities shall not be in force in this Commonwealth.
