Unauthorized Practice of Law Decision From the Indiana Supreme Court

IndianaEarlier this week, the Indiana Supreme Court ruled that an Indiana trust mill company so marginalized the role of an attorney that it committed the unauthorized practice of law.

The decision in State of Indiana, Ex. Rel. Indiana State Bar Association v. United Financial Systems Corp. ordered United Financial Systems to stop engaging in conduct that could be considered the unauthorized practice of law, noting that the company should have been on notice after a prior ruling against the company in 2006.

The court remanded the case for a decision on what expenses will be awarded to the Indiana State Bar Association for prosecuting the case.

Special thanks to Sean J. Fahey (attorney, Indianapolis) for brining this to my attention.
