State Statutes on Virtual Representation

Susan T. Bart Lyman W. WelchSusan T. Bart (Attorney, Chicago, IL.) and Lyman W. Welch (Attorney, Chicago, IL) recently published their article entitled State Statutes on Virtual Representation–A New State Survey, 35 ACTEC J. 368 (2010).

The Editor’s synopsis is below:

The common law doctrine of virtual representation has been greatly expanded by statute in at least forty-two states. These statutes typically authorize nonjudicial settlement agreements addressing various trust matters. More than half of the state statutes are based on the Uniform Trust Code, but a significant number are not. Following the article is a survey that details the current status of virtual representation statutes in the fifty states and District of Columbia.
