Same-Sex Marriages will NOT Resume on August 18
I recently mentioned that Judge Walker’s stay was going to be lifted on August 18, allowing same-sex marriages to resume at that time. Yesterday, however, a three-judge panel of the United States Court of Appeals for the Ninth Circuit extended the stay until it decides whether or not Proposition 8 is constitutional.
This case will be expedited; the briefs are due in September and the appeal is to be heard in December. One of the issues likely to be considered is whether a non-lawmaking group has legal standing to defend Proposition 8.
