Marital Agreements
There are three kinds of marital agreements – prenuptial, post-nuptial, and a marital separation agreement. Post-nuptial agreements can be the most troublesome. For all marital agreements though, there are certain tips that you should follow:
- Obtain independent, competent counsel for each party who is experienced in marital agreements.
- Be sure both parties fully disclose their property, including the property they expect to receive in the future.
- Clearly describe the property in the agreement.
- Clearly state an effective trigger in the agreement.
- Fund promises that are made in agreement
