Emese Florian recently published an article entitled, Legal Applied Anatomy- ‘After the Death of the Child, it Can Be Recognized Only if He Left Natural Descendants, [Art. 415 Para. (3) Civil Code] (May 13, 2013). Provided below is the introduction to the article from SSRN:
According to the Romanian Civil Code, the recognition offiliation, paternal or maternal, regard both babies, alive and also the deadbabies. In case of the recognition of predeceased children, under the penaltyof the filiation confidence cancellation, it is necessary that this one”should left natural descendants” [Art. 415 paragraph (3), lit. b) of theCivil Code].
