Article Analyzing Recent Washington Court Case, In re Huber

GuiedonRubinGideon Rothschild (Attorney in Asset Protection, NY) and Daniel Rubin (Attorney in Asset Protection, NY) recently published an article entitled, Alaska Asset Protection Trust Deemed Invalid Under Washington Law. Their article is about a recent Wahington case, In re Huber addressing asset protection trust which I have previously discussed. Provided below is a portion of his introduction: 

When advising clients about the efficacy of asset protection trusts, estate planners have long been concerned with theuncertainty regarding the conflict of laws issue. Although there have been ahandful of cases in this area over the years involving foreign trusts, almostall of which have applied public policy to invalidate spendthrift protections,until now, no cases have involved domestic trusts.  With the recentdecision of the Bankruptcy Court for the Western District of Washington in Inre Huber,1 however, we now have the first decision addressing the issue withregard to a domestic asset protection trust.
