More on Dawn Glanz Estate Sale

As I have previouslydiscussed, the U.S. District Court for the Northern District of Ohio has issueda temporary restraining order preventing Robert Brown, the husband of the lateDawn Glanz, from commencing a sale of Glanz’s estate pending further order ofthe Court.

The court issued the orderfollowing a complaint by Glanz’s sister, Gail Lincoln.  Lincoln complained that Brown intended tocause harm by frustrating the opportunity for an autopsy so that a proper causeof death could be established, failing to open an estate in Ohio so thatGlanz’s will could be properly administered, holding an improper estate sale,and failing to notify Lincoln of the sale so as to prevent her from asserting anylegitimate claims to the property.  Theseactions supposedly deprived Lincoln of property that was rightfully hers andattempted to dispose of the estate in a manner contrary to Ohio law.

The U.S. District Court haddiversity jurisdiction over this case with the amount in controversy exceeding$75,000.  Because certain conductcomplained of occurred in the Northern District of Ohio, venue was proper.
