Indian Adoption Case Closed

Gaveldown

As I have previouslydiscussed, the U.S. Supreme Court recently decided in Adoptive Couple v. Baby Girl to uphold the adoption of a child by aSouth Carolina couple despite the biological father’s objection under the IndianChild Welfare Act.

The case now seems settledafter the Supreme Court denied the Cherokee father’s plea to postpone the statecourt ruling authorizing the transfer of “Baby Veronica” to her adoptiveparents, the Capobiancos.  DissentersGinsburg and Sotomayor noted they would have granted his request.
