Living Man Deemed Legally Dead
In 1994, eight years after his disappearance, the HancockCounty Probate Court ruled that Donald Eugene Miller Jr. was legally dead. Miller, 61, recently reappeared and requestedfor a reversal of the death ruling in order to reinstate his Social Securitynumber and driver’s license.
Judge Allan Davis declined the request, ruling Miller isstill legally dead because his request came well after the three-year limit forchanging a death ruling.
Miller’s ex-wife asked for the 1994 death ruling so SocialSecurity benefits would be paid to their two children. She opposed a change in the death ruling,because she didn’t want to repay the benefits. Miller likely fled Ohio in 1994 because he was overdue on about $26,000in child support.
