A lesbian couple filed Bexar County’s first divorce some time in February. Allison Leona Flood Lesh and Kristi Lyn Lesh were married in 2010 in Washington and have a child. Despite the fact that Texas law does not permit gay marriage or divorce, two recent cases have challenged the law and are currently being reviewed. The divorce was filed just before Federal District Judge Orlando Garcia ruled that the ban against gay marriage is unconstitutional. That ruling is stayed until the Fifth Circuit rules on the issue. Unfortunately, this case shows what same sex couples are deprived of: benefits of an orderly divorce and the denial of the protection of their interests in their children in the event of a divorce.
