Pro-Con Debate on Prenups
There is a divide between legal professionals on whether prenuptial agreements should be a standard for to-be-married couples or an exception for those with individual circumstances that warrant the addition of a prenup. Cheryl L. Young, a Pennsylvania attorney, sees a prenup as a benefit for most couples, and as an additional planning tool that can be used to ensure that assets will be distributed according to the individual’s estate and financial plan. However, Laurie Israel, a Massachusetts attorney, views prenups as a limited tool to be used in specific circumstances such as a second marriage to protect children from previous relationships. Isreal notes that prenups are unfair for the individual coming into the marriage with less finances or earning potential as that person has less bargaining power and will feel forced into the prenuptial agreement, which breeds resentment.
