Trust Amended Through Power of Attorney

TrustA recent case from the Georgia Court of Appeals illustrates how easy trust modification can be in the state, and provides a caution for settlors intending to put stricter requirements in place.

In Strange v. Towns, the settlor executing a General Durable Financial Power of Attorney naming her son as executor of her estate and trust was enough to modify her inter vivos trust.
