Florida Gov. Rick Scott Signs Guardianship Reform Bill
The State of Florida has passed legislation that overhauls the guardianship process. The new law expressly prohibits exploitation, neglect, or abuse of a ward by a guardian. Courts are given more guidance when appointing a guardian. The law also changes the policy involving the suspension of power of attorney.
In extreme situations it is sometimes necessary to appoint an emergency temporary guardian, this new law changes some of the notice requirements for such circumstances. For-profit Corporations are now permitted to serve as guardians if certain prerequisites are met. The law goes onto make many other changes dealing with issues like incapacity, advanced healthcare directives, fees for attorneys, and expenses for guardians.
