Irish Gambler Wants IRS To Give Him $5.22 Million Tax Refund

GamblingAn Irish resident who won $17.4 million gambling in the United States would like the IRS to refund him $5.22 million that he claims was incorrectly paid in taxes.  John P. McManus is one of Ireland’s wealthiest residents.  Gambling income is usually taxable in the United States, but McManus claims that according to the terms of a 1997 treaty with Ireland he should be exempt.  The intent behind the treaty is to help U.S. citizens that are residents of Ireland avoid being subjected to double taxation.  Mr. McManus “filed a non-resident 2012 U.S. federal income tax return setting forth the gambling winnings, the amount withheld by the IRS and his entitlement to a refund based on a straightforward international tax treaty claim.”
