Every day for the past 10 years, I have run a case law search trying to spot every reported U.S. fiduciary litigation case decided the prior day, hoping to identify a development or trend in the law or learn a valuable lesson about fiduciary practice and administration. At the end of each year, I look back on the prior year’s cases and summarize (with help from a few friends) those that strike me as legally significant or otherwise noteworthy. Some cases make the cut under informal categories I have established, such as: hey, that’s a change in the lawthat can’t be the lawI never heard of thatdon’t do thatyes, do that. Others simply provided a candid look at our profession or humanity or made me shake my head in disbelief and wonder. In this article, I share the 2015 cases I found the most significant, curious, or downright fascinating.
