Article on Quoines in Cryptopia: When (If Ever) are Cryptoasset Exchanges Trustees?
Kevin F.K. Low recently published an article entitled, Quoines in Cryptopia: When (If Ever) are Cryptoasset Exchanges Trustees?, Wills, Trusts, & Estates Law journal (2020). Provided below is the abstract to the Article:
This case comment critically analyses the trust law aspects of B2C2 Ltd v Quoine Pte Ltd [2019] SGHC(I) 3; [2019] 4 SLR 17; Quoine Pte Ltd v B2C2 Ltd [2020] SGCA(I) 2; and Ruscoe v Cryptopia Ltd (in liq) [2020] NZHC 728. In particular, the process by which the three courts studied the questions of (i) whether cryptoassets are property that can be held on trust, and (ii) if so, when they are held on trusts by cryptoasset exchanges, are compared and critiqued.
