The American Bar Association is sponsoring a 90-minute teleconference and live audio webcast entitled Emotional and Psychological Issues of Estate Planning on November 15. The program information is below:
This practice tool packed program will discuss how to handle issues relating to the emotional & psychological issues of estate planning.
The panelists will discuss:
- Current tax issues: possible changes in exemption levels and pros and cons of portability;
- Hot issue for married couples: more or less control to surviving spouse over estate intended for children, especially if multiple marriages;
- Protecting client and heirs from possible trustee abuse; i.e. conditions for removal of trustee; How does the estate planner inform the trustee of his/her duties? Growing impact of litigation on trust and estate matters. Pros and cons of Trustee exculpation clauses;
- Succession planning for the family business;
- Counseling the client about unequal gifts;
- Advising the client whether to disclose or not disclose the estate plan to the heirs. What factors control the advice to be given;
- Pros and cons of advising clients on placing gift in trust for children, whether asset protection, financial education or responsibility, special needs or otherwise;
- How does the Attorney deal with the emotional and psychological aspects of these issues.
