Is the Ohio Trust Code an enactment of the Uniform Trust Code?
Earlier on this blog, I reported on the recent enactment of the Ohio Trust Code and explained that this enactment is not considered to be an enactment of the Uniform Trust Code. As authority for this statement, I linked the official website of the National Conference of Commissioners on Uniform State Laws which omits Ohio from its list of states where the UTC is either enacted or pending.
One of my kind readers, Scott A. Meyer, has pointed out that the chair of the UTC National Committee, David English, reports that Ohio is considered an enactment of the UTC.
Thus, either there is an error on the NCCUSL website or there is a debate going on regarding whether Ohio’s statute is sufficiently similar to the UTC to be considered an enactment.
