This may or may not be the correct choice and as malpractice suits become more common in the estate planning area situs will become a topic professionals become more concerned with for a number of reasons. What investment options are available, what transfer tax and income tax rules apply, what distribution standards mean, what rights parties under the documents have, what regulations are applicable, the duration of trusts, and a host of other issues make attention to the selection of a situs or the change to a new situs exceedingly important.
