“Deal or No Deal” — In Terrorem Clauses

In Jay MacDonald, Preventing squabbles over a will with no-contest clause, Bankrate.com, Nov. 15, 2006, the no-contest provision is described as a “‘deal or no deal’ proposition from beyond the crypt” which “takes equal parts psychology, mathematics and measured generosity” to be used effectively.
