Can an anatomical gift donor revoke the donation?
The issue of whether a kidney donor may revoke the donation is being raised in a case out of New York.
Here are the details as reported in Emily Smith, Husband demands money for kidney, WABC, Jan. 7, 2009:
- Dr. Richard Batista and Dawnell were married in 1990.
- In 2001, Richard saved Dawnell’s life by donating one of his kidneys to her.
- Later, Dawnell began having an extramarital affair.
- Then, in July 2005, she filed for divorce.
- Richard now wants either (1) the kidney returned, or (2) $1.5 million in compensation.
