Arizona Permits Personal Rep. to Consider Non-Probate Assets When Dividing Community Property at Death

Arizona New legislation in Arizona permits a personal representative to consider non-probate community property when dividing a decedent’s property.  The division of community property held in the estate and outside the estate is based on equal value but is not necessarily proportionate.  Act of July 10, 2009, ch. 85 Ariz.
