Changes to Wills, Trusts, & Estates Laws in Illinois
New legislation in Illinois has resulted in a number of changes related to Wills, Trusts, and Estates, including the following:
- Creation of a depository for orphan wills. 2009 Ill. Legis. Serv. P.A. 96-137.
- Enactment of state qualified terminable interest property trust legislation. 2009 Ill. Legis. Serv. P.A. 96-789.
- Enactment of the Banking Convenience Account for Depositors Act, allowing banks to offer convenience accounts. In a curious provision of the bill, this statute is automatically repealed on January 1, 2015. 2009 Ill. Legis. Serv. P.A. 96-123.
- Weakening the formalities necessary for a valid do not resuscitate request. The DNR form now needs only one witness instead of two. However, this witnesses must attest to a greater number of events surrounding the document’s execution. 2009 Ill. Legis. Serv. P.A. 96-765.
