CLE to Discuss Malpractice Avoidance for Estate Planners

TexasBarCLE is sponsoring an audio webcast CLE entitled Malpractice Avoidance for Estate Planners: Practicing Trust and Estate Law Effectively, Carefully and Defensively on April 14, 2010.

The webcast will consist of a three hour discussion covering the practical and ethical issues and challenges that estate planning and probate attorneys deal with on a daily basis. The issues covered will include:

  • Estate planning issues: careful selection of clients, withdrawing from representation, joint and multi-generational clients, file maintenance, knowing the limits of your expertise and capacity to take on work, marital property agreements, keeping original documents, fee agreements and fee setting, documentation of the engagement, & terminating the relationship.
  • Estate administration issues: limitation and documentation of representation, fee agreements and fee setting, documentation of the engagement & termination of the relationship.
  • Representing trustees: consideration of individual and/or corporate fiduciaries, sole and co-trustees situations, defining the relationship and fees, instructing trustees regarding their duties, & measurement of fiduciary performance.
  • Review of the proposed new rules and discussion of how they may impact the practice.
