CLE on Joint Representation
The ALI-ABA is sponsoring a 60-minute live telephone seminar and live audio webcast on March 21, 2012 entitled, When Consent is Not Enough: Ethical Issues in Joint Representations. A description of the course is below:
It is quite common for lawyers to represent multiple parties in a matter, for example business partners, family members, or an employer and employee. Yet such joint representations also involve a number of potentially complex legal issues, which lawyers often overlook at their peril.
This practical ethics program will show you how to assess and resolve the risks that can arise from joint representations. Learn how to identify and manage potential conflicts early on, address privilege and confidentiality issues, and resolve disagreements among your clients. Topics to be discussed include:
-
- Assessing conflicts before and during a joint representation
- Confidentiality and privilege issues for joint clients, including the joint defense privilege
- Handling disagreements among joint clients
- When and how to withdraw from a joint representation
- And more!
Reference will be made throughout the program to the latest ABA Model Rules and state ethics rules, ethics opinions, and case law.
This interactive seminar gives you the opportunity to submit your questions before and during the program for discussion by the faculty. In addition, registrants will receive free access to the archived online program and materials later.
Need ethics credit? This seminar qualifies for 1.0 to 1.2 ethics credit hours, depending on state requirements, in MCLE jurisdictions that accredit live telephone seminars and/or webcasts.
