Majali’s Family Asks Court to Set Aside Arbitration Award
Sandile Majali, ANC benefactor, passed away and now hisfamily is asking the Johannesburg High Court to set aside an arbitrator’sdecision awarding ownership of Siyanda Chrome Investments to Lindani Mthwa.
Majali and Mthwa each claimed to hold all shares in thecompany. In October 2010, withouthearing representations by Majali, an arbitrator decided that Mthwa owned allof the company. Majali did bringan application to set aside the award, but he died in December 2010 before thecourt could hear the application. Aspokesperson for the executors told the court that it could intervene if “anarbitrator had committed gross irregularity, exceeded his powers or when anaward was improperly obtained.”
