Estate planning often involves a client’s transfer of assetsto dispose property for the benefit of family members and to achieve optimaltax benefits. However, as demonstrated in recent court decisions, the transferof assets for such estate planning purposes could injure the rights of aclient’s creditor. The consequences of a successful fraudulent transfer claimcould extend beyond mere reversal of the client’s estate planning transfer.During this session our panelists will cover the application of fraudulenttransfers in the context of estate planning and administration. They willexplain the essential principles of fraudulent transfer law and then discussthe fraudulent transfer implications for the following transfers that arecommonly utilized as part of the estate planning and administration process:
- Transfersto irrevocable trusts, including asset protection trusts;
- Transfersto and from business entities, (such as partnerships and LLCs); and
- Transferswhich affect or shift interests of beneficiaries of the decedent’s estate.
