Petition Filed to Prevent Ninth Circuit Ruling From Being Enacted Immediately
In California, Attorney’s on behalf of groups against gay marriage appealed to the Supreme Court to reverse a federal appeals court order that issued an order to immediately vacate an injunction. According to ProtectMarraige.com the decision by the Ninth U.S. Circuit Court of Appeals lifted an injunction on same sex couples from getting legally wed. The attorneys seeking the reversal are hoping to sway the U.S. Supreme Court by arguing that the court should follow precedent. Usually there is a wait period that passes prior to enacting descions. However, the waiting period was bypassed. As a result attorney’s claimed that “permitting the Ninth Circuit to prematurely dissolve its stay order would effectively deprive petitioners of a meaningful opportunity to exercise their right to petition for rehearing.”
